Terms and Conditions for Win Ahead, the Business Name Registered under Trackmaster Investments Pty Ltd (ACN 669105266):
These terms of use outline the conditions under which Win Ahead, a business entity registered under Trackmaster Investments Pty Ltd, grants you access to racehorse selections and promotional giveaways, and regulates your utilization of our website, accessible at winahead.com.au (referred to as the & quote; Site & quote;), as well as the features, content, and services provided through it (collectively known as the & quote; Service & quote;).
Moreover, throughout these terms of use, references to Win Ahead; also encompass Trackmaster Investments Pty Ltd.
Your usage of the Site and/or the Service, or the acquisition of our membership, indicates your acceptance of these terms of use and constitutes a legally binding agreement, including any modifications made by Win Ahead from time to time. If you do not consent to these terms of use, refrain from using the Site or the Service.
Win Ahead reserves the right to modify these terms of use at any time by publishing the revised terms on our Site. By continuing to use the Site or the Service after such modifications, you agree to be bound by the updated terms. Win Ahead retains the authority to alter the Site and/or the Service as deemed necessary. You acknowledge that Win Ahead may terminate or limit your
access to the Site and/or the Service for any reason, with or without notice.

Privacy Policy
By purchasing a membership and using our platform, you represent that you have read and consent to our Privacy Policy, in addition to these terms and conditions. Win Ahead may revise the Privacy Policy at any time, and the new versions will be posted on our Site. If at any point you do not agree to any portion of the Privacy Policy, you must immediately stop using the Site and/or the Service. Your continuation of membership constitutes your agreement to the current or amended policies.

Services
The Win Ahead Site is a membership rewards platform that offers its members racehorse selections across Australia. Members get access to the racehorse selections through a link passed on via the registered E-mail of the member. That link and the information it contains is solely for the paying member and member only. Passing on the link to the public domain that are non-members will lead to termination of membership.
Win Ahead offers an ongoing subscription to the platform that is direct debited monthly until cancelled.
The members are rewarded by the duration they are members entering promotional draws exclusively to current members held monthly. The increase in entries only apply to the two major end of month draws and if a member is a major winner your membership reverts back to the x1 entry accumulating entries again same as initial process.                                                                              The Fuel Prize is calculated on average use of 70 litters a week therefore prize monetary value is 280 litre x Diesel price at the start of the month prize was won. The Corporate Dining Prize is purchased by Win Ahead in the state the member resides in. Win Ahead will purchase the most suitable package at the time.
To use certain portions of the Site and Service, you will be directed to register on the Site and create a user profile or account (Account). Eligibility is limited to persons equal to or over the age of 18.
Win Ahead reserves the right to add, change, modify, suspend or discontinue any portion of this Service, in its sole discretion, at any time. Your use of the Site and/or the Service, including the availability of new services through the Site, shall be subject to these terms and conditions. In addition, Win Ahead may impose limits on any portion of the Service or restrict your access to portions of or the entire Site in its sole discretion without notice or liability.
Win Ahead employees, directors, managers and their respective immediate family members
(i.e., parents, spouses, domestic partners, siblings and children) or any other person residing in the same household as a Win Ahead employee, director or manager may not win the offered giveaways.

Representation and Warranties of Members
The Participant represents and warrants that it shall not contact any affiliate, employee, sponsor or partner of Win Ahead in order to manipulate the promotional Contest results.

Subscription Charges:
Win Ahead reserves the right to adjust the monthly subscription charge at any time as deemed necessary to match the value of services provided to members. In the event of a subscription charge increase, members will be notified at least 28 days in advance.
Members will have the option to cancel their membership before the increased subscription charge takes effect if they do not wish to continue with the revised terms.

Account Termination:
You acknowledge and agree that you do not possess any ownership rights in your account and Win Ahead reserves the right to discontinue the provision of the Service at any time.
Moreover, Win Ahead retains the authority to terminate your account, erase all your Registration Information and any other data you have submitted through the Site (referred to collectively as User Content) associated with your account, without prior notice, for any reason or no reason. Such reasons may include, but are not limited to, your violation of these terms and conditions or applicable laws and regulations. Win Ahead shall not be held liable for any damages or losses resulting from the deletion of User Content from the Site and/or the Service, or from the termination of your account.
To initiate the cancellation of your account, simply send a request to info@winahead.com.au.
Upon receipt of your request, our administrative staff will process the cancellation of your membership within 24 hours.
Upon cancellation of your membership, which must be requested via email, all future payments will be ceased, and any bonus entries accumulated for future promotional giveaways will be removed.
In the event of payment failure for your account, four automatic billing attempts will be made.
These attempts will occur every 5 days (with a 20-day grace period) following the initial payment failure. On the fourth and final attempt, if there are insufficient funds, your subscription will be terminated, resulting in the loss of your loyalty streak.
Should you choose to cancel your subscription, please note that Stripe does not allow for its reactivation, and all accumulated history associated with that subscription will be lost. To continue your subscription, please follow the instructions provided in the notification emails.
Please be aware that the system permits only four attempts, which includes any manual attempts made by the user to charge the account.

Refunds, Returns, and Exchanges:

By purchasing a membership, you are providing valuable support to the Win Ahead brand. Please be aware that memberships, once purchased or renewed, are non-refundable.
Our goods and services are covered by guarantees that are protected under Australian Consumer Law. In the case of significant failures, you have the right to:
 Terminate your service contract with us; and
 Receive a refund for any unused portion or compensation for its diminished value.
 You also have the option to choose between a refund or replacement for significant failures with goods.
For issues that do not qualify as major failures, we are committed to resolving them promptly. If we are unable to do so, you have the following options:
 Cancel the service.
 Receive a refund for the goods.
Please note that refunds or rectifications cannot be provided for reasons such as a change of
mind or failure to properly understand.

Account Confidentiality and Security:
Registration is required to access specific sections of the Site and Service. Eligibility is restricted to individuals aged 18 and above.
During registration, you will be prompted to provide personal details such as your name, address, email address, and other relevant information. It is essential that all information submitted to Win Ahead for account creation is truthful, accurate, up-to-date, and complete. Failure to provide accurate information may result in the immediate termination of your Account.
It is your responsibility to ensure the confidentiality of your password and to promptly update your registration information to reflect any changes. You are prohibited from:
 Using another person's email address or username with the intent to impersonate them.
 Utilizing a name that infringes upon the rights of others without proper authorization.
 Selecting an email address or username that is offensive or inappropriate.
 Allowing any unauthorized party access to your Account or password.
Sharing or transferring your Account is strictly prohibited, and you must not disclose your password to anyone. If you suspect unauthorized use or a breach of security, including loss or theft of your password, you must notify Win Ahead immediately by emailing info@winahead.com.au. You acknowledge that you are responsible for all activities conducted under your Account, regardless of whether they were authorized by you. Win Ahead shall not be held liable for any loss or damage resulting from your failure to maintain password confidentiality.

Use of Site and Service:
By using the Win Ahead site or service, you agree to comply with all applicable laws and regulations. This includes:
 Respecting Intellectual Property: You agree not to infringe upon the copyrights,
trademarks, patents, or other intellectual property rights of others. This includes not
sharing material that violates these rights, such as copyrighted content or
trademarks.
 Prohibited Activities: You agree not to engage in any activities that could disrupt or
harm the site or service, including:
 Attempting to gain unauthorized access to the site or service.

 Using the site for illegal purposes, such as harassment, phishing, or
impersonation.
 Uploading or transmitting harmful or offensive content.
 Violating any laws or regulations, including those related to fraud or privacy.
 Monitoring and Disclosure: We may monitor and access your user content and
communications as necessary to provide the service. This may include disclosing
information in response to legal requests or to protect the rights or safety of others.
 Compliance with Laws: Your use of the site and service must comply with all

property rights. You are responsible for any violations of these laws or third-party
rights caused by your use of the site or service.

Win Ahead reserves the right to revoke its consent to the link at any time and at its sole discretion.

Promotional Contest Disclaimer:
By participating in any contest or promotional giveaway hosted by Win Ahead, participants
agree to the following terms and conditions:
1. Dispute Resolution: Any disputes, claims, or causes of action arising from or
related to the contest shall be resolved individually, without resort to any form of class action.
2. Limitation of Liability: Participants agree that any claims, judgments, and awards shall be limited to actual out-of-pocket expenses incurred in entering the contest. Win Ahead shall not be liable for any legal fees or for punitive, incidental, consequential, or multiplied damages.
3. Release of Liability: Participants release Win Ahead, its licensees, affiliates,
subsidiaries, officers, directors, employees, representatives, and agents from any
liability for damages or losses of any kind, including direct, indirect, incidental,
consequential, or punitive damages arising from access to, or use of, the website,
electronic or computer malfunctions, or participation in the contest.
4. Disqualification: Win Ahead reserves the right to disqualify any participant found tampering with or abusing any aspect of the contest, as determined solely by Win Ahead.
5. Contest Modification: In the event the contest is compromised by unauthorized
human intervention, tampering, or other causes beyond Win Ahead control, Win
Ahead reserves the right to suspend, modify, or terminate the contest.
6. Attempted Damage: Participants agree that any attempt to deliberately damage the website or undermine the legitimate operation of the contest may result in civil or criminal penalties and Win Ahead reserves the right to seek damages to the fullest extent permitted by law.
7. Technical Malfunctions: Win Ahead assumes no responsibility for any problems or technical malfunction of computer systems, servers, software, internet service
providers, or email systems that may affect participation in the contest.
8. Void Where Prohibited: The contest is void where prohibited or restricted by law.
